K1 Visa Denied

Today my fiance's application for a K1 Visa was denied due to Section 212 (a)(4) (potential to become a public charge). I tried contacting the US Embassy in Bangkok to see what other options we have to possibly overturn this decision and we were replied with a link to Form I-134. The reason why the application was denied was mainly due to me not earning enough money and the interviewee stated that joint sponsors are not accepted for K1 visas where the primary sponsor does not earn close to $20,000.  I was told by a few people that my joint sponsor should write a letter for the embassy to explain how he will help to prevent my fiance from becoming a public charge and why I needed a joint sponsor because I am about to graduate from college.  

 

I am curious is anybody has any advice on what next step we should take outside of trying to go for a CR1 visa. Is it likely that the letter will make any difference and influence the embassy to change their decision?

221G ON DAY OF INTERVIEW. Long story but I found a landmine that you can avoid: First of all, Jaz's interview went well until they got to the NBI. Irene (Jaz is her nickname) was born in a Nipa hut outside Bato Leyte. She was delivered by a midwife who was elderly and illiterate. Her mother told her the name was to be 'Irene' but the midwife wrote on the paperwork, 'Irwin'. So that is how her birth certificate read until they could come up with enough money to fix it.......28 years later.

 

When Jaz went to NSO to get her BC, it said there was a name change but I didn't catch that part and she went to NBI to get a clearance for 'Irene' and not also for A.K.A 'Irwin' so the Embassy consular decided that every thing looked good except the NBI and that her Visa would be approved once he got an NBI for A.K.A Irwin,. In the meantime, he issued a 221g. 

 

Jaz had to go back to NBI and request a clearance for both names and that delayed us. She got her new NBI 10 days later and we forwarded that to the Embassy via 2go as soon as she got it this last Tuesday. Now we're just waiting for them to update CEAC which they did, but only to today's date, it still says Administrative Processing so I assume that means they got the new NBI and are dealing with it. 

 

We can only hope the Embassy will process her Visa quickly and deliver it to 2go MOA in time to get her here by Christmas if there are any seats or even flights available.

 

So, if your fiance has had a name change at anytime for any reason on her/his Birth Certificate, be sure to get an NBI clearance for any other names and save yourself the pain of having to wait more weeks...they call it A.K.A (Also Known As) Irene talked to and overheard about five different Filipinas and one 'really beautiful ladyboy' that had the same problem. They all had to do the same thing...go back to NBI and get a clearance for the other name they had before changing their BC. Good luck to you all!

Hello all, this is my first post on Visa-journey after countless hours reading all the great information here I want to make sure I have everything I need for my I-130 petition for my wife and 2 stepchildren. 

 

My wife and I were married Oct 7th of this year (2016) in HCMC Vietnam; We have not lived together nor do we have joint bank accounts or property...

 

We do have:

Her listed as my Primary beneficiary for my life insurance.

Receipts for wedding reception expenses/Rings/Food/MC/DJ/Photographer/Tux & Wedding Dress/Bus tickets/Hotel/Airplane Boarding passes.

Email logs.

Chat logs.

Skype logs.

Facebook posts.

Photos of us with her family on several occasions including our wedding.

Photos and receipts from trips we took together (just the 2 of us)

Photos and receipts from trips we took together with her 2 children / my 2 step daughters.

 

We also have Certified/Translated copies of the following:

Marriage Certificate

Birth Certificates

Certificate of Criminal Records

Household Registrar

Passport sized photos  

 

I have filled out (3) I-130 petitions, one each for my wife and 2 stepdaughters (4 years old and 2 years old).

I have also filled out 2 G-325A Bigraphic Information forms; One for myself and one for my wife.

 

Do I need to file a G-325A for my stepdaughters as well?

What about fees for my step children?

 

Any advice/suggestions would be greatly appreciated.

Yesterday I received an email from NVC providing me my case # and IIN. YAY!!!  I paid the AOS fee, no problem.

In the email where it states the financial documents to provide, it states that all civil documents be copies ( I already knew that as I've read the NVC Wiki a dozen times over, but nonetheless, I got confused on this next part), then they said that the Original signed affidavit of support needs to be submitted. I thought that we only send NVC a copy and bring the original with us to the interview..?? Please advise.

Hey everyone!!

So finally I got my case completed yay!!! and today I got a checklist 😩😩😩 .. When I called before the lady said my case is complete no documents needed.

So why did NVC send me checklist? Anyone ever been in this situation? Please share your experience!!!

Getting married after F2B, or K1? (split and merge)

HI guys, i will go to USA in June 2017 but before i go i would like to marry my girlfriend

and call her to USA. 

 

I will go to USA with F2B, after i got the Green card can i apply K1 for my girlfriend?

How many days she has to wait for visa?

 

Anyone know about it kindly advise.

 

 

K-3 and IR1 Visa for same-sex marriage

I am a dual citizen of USA and Hong Kong, and my spouse is a citizen of Hong Kong.

 

 

I and my spouse were married in New Zealand because we are not allowed to have same-sex marriage in Hong Kong.

 

 

According to the US Visas website "a foreign citizen who marries a U.S. citizen outside the U.S. must apply for the K-3 visa in the country where the marriage took place."

 

 

Does that mean we have to travel back to New Zealand  to apply for a K-3 Visa?  What about IR1 visa?

 

 


Checked status online and saw Intent to Revoke Notice

I check our status online and saw that an intent to revoke letter was sent yesterday.  I haven't received the actually letter yet however.  I have a lot of stuff that I am putting together but i would like some advice on what specific things I need to have in the evidence package.   Also any other advice would help.  Thank you.

Firing Attorney with fixed fee , how??

Hi you guys,

 

at the very beginning of my petition me and my husband decided to seek the help of an immigration attorney due to a red flag in my petition. 

We had a couple of consultations and decided to go with our current attorney since she claimed to have consular processing experience and she graduated cum laude from a vey good law school. That all came with a big price tag of 3,6k, roughly 3,8k when you calculate additional little costs that weren't mentioned in the consultation like scanning, copying and sending mail via fedex. 

 

All in all she did a ok job, we did not receive any RFE's from USCIS and E-mails are- to this day- answered very quickly with a detailed response.

We did not have any problems since we hit the NVC stage. 

 

She prepared the whole IV package sent it out, it's been sitting at the NVC for 7 weeks till we got a Checklist... she forgot to add the police certificate. 

I got very mad and sent her the police certificate right away since it has been in my possession since august- i knew it was eventually needed. She did not apologize in her E-mail response, no, she asked me for a translation which is apparently needed at the NVC.  Now i heard before that it is not necessary to translate anything if the visa is being processed at the US Embassy of your origin and there is no certificate in any other language. In my case Germany. 

Then i asked her about the Checklist- it still had my old last name on there.. she said WE (what does that even mean.. SHE needs to handle stuff like that, i paid her for that.) need to get that taken care off before the interview. Then she also said if i wish to have this sent via electronic processing to say so, she will sent it out.

 

I just got off the Phone with the NVC. Nice man told me that: I do NOT need a translation, we CANNOT change from hard copy mail to electronic processing while the case is already in process- meaning she needs to sent out the police certificate via hard mail and the name change should have been done by submitting a copy of my new passport with my new name WAY LONG AGO.

 

At this point i have had it. Not only did she provide faulty information, she would've made us wait even longer if she actually submitted that stuff via electronic processing to find out we can't even do that!!!!! 

I want to talk to my hubs as soon as he wakes and talk to her about firing her.

 

How is it handled with the fixed fee? She did not earn all her money at all.

I know there has to be a written statement, does anybody have recommendations??

i was curious i know there are 2 options for doing ssn

 

 

1. do ssn , marry, and update ssn with married name , then file AOS

2. marry , do ssn after marry , then file AOS

3. wait till green card to change married name on ssn

 

 

but i know it depends on the state your in what your able to do , for NC what options are doable in nc? i would prefer to do it the first way , but just wanted to see what other nc ppl did

Hi, I just wanted to see if someone could clarify for my fiance and I. His case is being handled by the embassy in Mumbai, India.

 

Our case was received by the embassy on 12/2/2016. Because his mailing address has changed, we had been directed to have him complete the DS-160 with the updated contact information, which he did so over the weekend.

 

I called the NVC yesterday to ask them if they could communicate the change of address as well to the embassy, just to be on the safe side. They said to contact the embassy directly with the changes. Needless to say, everyone time he tries to call he cannot get a person on the phone and the one he did directed him to email support-india@ustraveldocs.com with the updated information, which I already did in advance for him. 

 

However, I got a reply back stating they wanted his appointment of interview confirmation in order to change the address! He has not paid or scheduled the interview yet, because from our understanding, the packet 3 is necessary to have to follow the application steps since it seems some embassies handle things differently.

 

Can somebody please clarify what we should do? We know what materials he needs to bring to the interview, but I read somewhere that some embassies want the material mailed before to them such as the Police Clearance report.

 

Or, should he go ahead and schedule the medical and interview and just bring all the required documents with him?

USC Divorce wants to get married in HK

I am divorce, but still married in the Philippines.  I am a Filipina, but my American husband initiated the divorce, I am already USC that time. I am planning to marry my Filipino fiancé but I am still married in the Philippines.  I have read that I need to get it amended by Philippine Law and cost me 200k and 6-12 months of processing.  I don't wanna wait that long.  I have also read that once a divorce USC, can get married again in the Philippines.  I am not sure, it did not emphasize that they have their divorce decree amended.  But can I get married in Hongkong instead? I wanted to file him I-130 so I can bring him here with me.  We have file I-129-f in the past but the consul who interviewed us is not convinced of the relationship, they mentioned our age gap (he is 12 years younger).  He also asked me about my ex husband because we are still in the same address.  I told him, he live in the mother in law apartment and we don't have anymore relationship, divorce 2010.  But he just noded.. after a month of the interview, I submitted 200 pages of chat logs, 15 pictures and wedding plan.  They never even asked for my I-134 Affidavit of Support and ITR.  I only submitted documents that they are wanting from us.  I don't wanna waste anymore time waiting for their decision.  I am planning to go back in the Philippines on March and get married in Hongkong.  I am just worried the Manila Embassy will question about the HK marriage and if they run my CENOMAR, and shows up my marriage. I am not sure if it will be a problem in the future.  Please has anyone of you here can give me an advise or know anyone in same situation that I have and it passed through Manila Embassy?  Thank you eeveryone.

Hello

im really confused about the date to file I751. :wacko:

 

the date my Immigrant visa granted was Dec 29,2014. IV issue date is the same as i see on the IV page inside my passport

the date I entered to the States was Apr 23,2015, GreenCard issue date is the same. Expiration date on GreenCard itself says Apr 23,2017

(also i still have the paper that i received from CBP officer that says, expiration date is Apr 23,2017)

 

now, When do i have to file I751 to remove the condition until?? until Dec 29,2016?

or Apr 23,2017?

 

on USCIS site, it says to file prior 90days before the card expiration date.  so according to that, i thought ill have to apply until Apr 23.2017 which is from Jan 24,2017 to Apr 23,2017. but, i received the reminder notice letter from USCIS immigration service center saying "our record indicate that you entered to the United States on Dec 29,2014 as Conditional Permanent Residence(CPR). you must file I751 to remove the condition ~~~"

 

the date on the reminder letter is the date my visa was granted. not when i entered to the States.

 

which is correct?

when i seach on the net, most people says they filed by GC expiration date but i see some people filed by Immigrant visa issue date.

Has USCIS changed the rule about the date recently???

 

ive called USCIS customer service and asked few different representive(?), they all said they cant look into my record (information) since they dont have access to get into the system.. they suggested me to get INFOpass and ask about the date at the local office. so i went to the office and asked.  then i was told to file by Card expiration date, not worry about the letter.. but i dont think he fixed the date on their system.  so im still worried that they have wrong date on their system since the reminder letter has the wrong date (visa date, not card expiration date).

 

should i file by card expiration date as the man at USCIS office said?

 

what im worried that USCIS will tell me that my greencard is terminated after Dec 29,2016...If i file I751 after Jan 24,2017.

should i try to gather all the paperwork for Evidence and file I-751 before Dec 29 just in case? (i dont have all the paperwork now)

 

also, reminder letter was sent to my old address...even though ive changed address (AR11) on online months ago. so they might still have old address as my address not new address....

 

any advise would be appreciated.

My fiancé arrived in Cebu last Tuesday from Sweden. She wanted to book a schedule for the CFO seminar for next week, but it's been fully booked. The soonest availability date is Dec. 21 as they can only take 12 people at a time.

Now here lies the problem, we have booked her flight for the US on Dec. 15.

Can she skip the CFO seminar?

Her fiancé visa was issued in Stockholm, Sweden last November. She was only in Cebu for a vacation for 10 days.
